Stop TennesSee Bill SB1868/HB2526

Tennessee is considering a bill (SB1868/HB2526) that could extend detention times for children based solely on an allegation, without due process. 

What we are asking is that while the legislation is being debated, it should be further amended to include the following language:

“If the child is alleged to have committed an assault against a staff member at the child’s residential placement, a petition of delinquency must be filed, and the child must be allowed to respond to the petition within 72 hours, with legal counsel available, before a juvenile court. The court must also find that the child committed a delinquent act before it can order that the child remain in custody for an additional period of up to six (6) months.”

Everyone is innocent unless proven guilty, and that includes children being held in detention for a delinquent act.
